Dangerous Goods by Road, National regulations differ to ADR

Carriage of Dangerous Goods by Road Regulations (CDGRR) 2004 S.I. No. 29 of 2004

National regulations in Ireland differ to ADR regulations in liability.

In regulation 10 of the above regulations, the Irish Authorities will hold one or more of the following liable in the event of an infringement, Consignor, Carrier, Loader, Packer, Filler, Tank Operator, and the driver of the vehicle.

The fines are currently Euro 1900.00 per person, per infringement, as listed in Regulations 12 to 38 and some simple examples are that the loader and consignor could be fined for not placarding the container prior to loading the dangerous goods, or for not checking the drivers valid training certificate before loading the shipment, or the consignee for not removing the placards from the container after offloading.
